Valdosta State University and its former president, Ronald M. Zaccari, violated the due process rights of a student when they kicked him out in 2007 without giving him a hearing and advance notice of the charges against him, a federal judge ruled last week. The ruling came in a lawsuit brought by T. Hayden Barnes, who was "administratively withdrawn" by Valdosta officials after he vigorously criticized administrators' decision making in flyers, on Facebook and in other venues. The judge ruled that Zaccari is personally liable for damages, forfeiting qualified immunity because he ignored standing law. "This crucial victory makes clear that no university president is above the law," said Greg Lukianoff, president of the Foundation for Individual Rights in Education, which represented Barnes. "Hayden's long nightmare is over and justice has been served. Ronald Zaccari will be held personally accountable for his flagrant disregard of Hayden's constitutional rights."
